Municipal Court
Municipal Court matters primarily involve breaches of local by-laws and community regulations resolved efficiently to support public order and responsible civic conduct. Common examples of these include offences such as littering, sanitation violations, public nuisance matters, and breaches of trade or licensing regulations. The court also manages enforcement proceedings where the Magistrate determines penalties, compliance measures, or payment of fines for violations committed within municipal jurisdictions. Furthermore, the court facilitates the resolution process, allowing individuals or businesses to address complaints, disputes, or regulatory matters through lawful proceedings.
Criminal Matters
Criminal matters in the Magistrate Court primarily involve Summary Offences, which are less serious crimes resolved efficiently without a jury. Common examples of these include offences such as, minor assault, disorderly conduct, and harm. The court also manages the preliminary stages of more serious Indictable Offences, such as sexual offences, murder and large illegal drugs matter where the Magistrate determines if there is sufficient evidence to send the matter to the High Court. The Court daily deals with bail Applications to determine if a defendant can be released before trial. Furthermore, the court facilitates the Appeals process, allowing a defendant to challenge a judgement or conviction.
Police (Traffic) Offences
Police Traffic Offences are initiated when a police officer (rather than a traffic officer) officially charges an individual with a violation of road safety laws. Following the charge, the person is taken to the police station, where the specific nature of the offences, such as driving under the influence (DUI), reckless driving, or driving without a valid license or insurance, determines the next steps. Depending on the severity of the charge, the individual may be granted police bail, allowing them to be released from custody on the condition that they appear before the Magistrate at a later date. This process ensures that serious offenders are formally processed through the station before their matter is heard in court, where a Magistrate will ultimately decide on penalties like heavy fines or the suspension of driving privileges.
Civil
The civil division of the Magistrate Court focuses on resolving private disputes between individuals or businesses, typically involving Small Debt recovery. A significant portion of this caseload involves Rental Arrears and Eviction proceedings. In these cases, the court reviews evidence from landlords regarding unpaid rent and, if necessary, issues an "Eviction Order" to legally remove a tenant or a " Judgment Order" to enforce the repayment of the debt.
Family Court
Family Court matters primarily involve disputes relating to children, domestic relationships, and family responsibilities resolved through legal procedures designed to protect the wellbeing of all parties involved. Common examples of these include matters such as child maintenance, custody and access arrangements, guardianship applications, and protection orders. The court also manages sensitive family-related disputes where the Magistrate considers the rights, responsibilities, and best interests of those affected. Furthermore, the court facilitates mediation and hearings, allowing individuals to seek fair resolutions and legal protection in accordance with the law.
